These terms are an agreement between you and PeakSync LLC (“NextUp,” “we,” “us”). By ordering a profile, submitting information, or using nextup.peak-sync.com or any NextUp profile page, you agree to these terms and to our Privacy Policy.
1.What NextUp is
NextUp builds and hosts public recruiting profile pages and team pages for youth soccer players, plus tools like outreach templates. NextUp is not a sports agent and doesn’t negotiate for anyone. We don’t promise that any coach will view, contact, recruit, or offer a roster spot or scholarship to any player.
2.Who can order
A profile may be ordered only by the player’s parent or legal guardian (18 or older), or by a player who is 18 or older. Players aged 13 to 17 must also agree to their profile and published contact details. For players under 13, the published contact is the parent’s or guardian’s email unless the parent specifically opts in to showing the child’s own. For players under 13, the parent or guardian must complete our verifiable parental consent steps before we collect or publish anything (Privacy Policy, section 4). Club representatives placing Club Pack orders must collect each family’s signed consent on our form before submitting any player’s information.
3.Published contact information
Profiles can publish a player’s email address and a contact form so that college coaches can reach the player. Player email addresses are visible on profiles on purpose, so coaches can contact players directly. By choosing to publish it, the parent or guardian (and the player, if 13 or older) agrees that it will be publicly visible. You can remove or change it at any time (section 7).
4.Prices, delivery, and refunds
Prices are shown before you pay: Player Profile $100 one time; Club Pack $999 one time for up to 20 players; optional Care Plan $199/year; optional custom-domain setup $30; optional white-label $150. Payments are processed by Gumroad under its terms. We aim to publish within 7 days of a complete intake (Club Pack: 14 days).
Refunds: Changed your mind before we start building? Email jerry@peak-sync.com and we will refund you in full, no questions asked. Once your profile (or team hub page) is built and live, the order is complete and the payment is non-refundable.
5.Your content
You keep ownership of the photos, video, and text you send us. You give us a non-exclusive, royalty-free license to host, format, and display it on the player’s profile, team pages, and NextUp’s directory and search features while the profile is active. You confirm you have the right to share it (including photos and video taken by others and images of other people), and that it’s accurate to the best of your knowledge. Don’t submit false stats, offers, or commitments, or anything unlawful, harassing, or sexual. We may edit for format, decline content, or remove content that breaks these terms.
6.Club coach confirmations
A “confirmed by club coach” note means the coach confirmed that specific detail at that time. It isn’t an evaluation or endorsement by NextUp or the club. Other details come from the family and aren’t independently verified.
7.Updates and removal
A parent or guardian, or a player 18 or older, may update, remove contact details from, make unlisted (reachable only by link, not in search engines or the NextUp directory), or take down a profile at any time by emailing jerry@peak-sync.com or using the “Update or remove this profile” link on the profile. Takedowns happen within 2 business days.
8.Coaches and visitors
Viewing profiles is free. You may view and share profile links to evaluate and recruit players. You may not scrape or copy profiles in bulk, resell or build databases from NextUp content, harass anyone, or contact a player in a way that breaks the recruiting rules that apply to you or the player’s age. Please copy the listed parent or guardian contact when you reach out. We may block anyone who misuses the site.
9.Recruiting rules
NCAA, NAIA, NJCAA, and other rules govern recruiting and change often. Families and coaches are each responsible for following the rules that apply to them. Our guides and templates are general information, not compliance advice.
10.Third parties
NextUp uses services such as Gumroad, Cloudflare, FormSubmit, YouTube, and Instagram, whose own terms apply. League, club, or app logos on our site don’t mean those organizations endorse or partner with NextUp unless we say so.
11.Disclaimers and liability
NextUp is provided “as is.” To the extent the law allows, we disclaim implied warranties, aren’t liable for indirect or consequential damages or for any recruiting or admissions outcome, and our total liability for any claim is limited to what you paid us in the 12 months before it. Some laws don’t allow these limits, so they may not apply to you.
12.Disputes
California law governs these terms. Please email us first so we can try to fix the problem. Disputes we can’t resolve informally will be handled in the state or federal courts located in Los Angeles County, California.
13.Changes
We’ll post updates here with a new date and email active customers about material changes. Changes don’t apply to orders already paid.
